1. About these terms
These terms are an agreement between Bitosoft Innovations Hub Co. Ltd ("we", "us") and the school or organisation that subscribes to Twegese ("the school", "you"). Whoever accepts them for a school confirms they have authority to do so. If the school has signed a separate written agreement with us, that agreement takes priority where it differs from these terms.
Our details:
- Bitosoft Innovations Hub Co. Ltd, a company registered in Uganda.
- Address: Masindi, Uganda.
- Email: [email protected]
2. The service
Twegese is web-based school management software. The features available depend on your plan. We may improve and change Twegese over time. We will not remove a core feature your school relies on during a term it has paid for without telling you in advance.
Twegese is not affiliated with or endorsed by the Uganda National Examinations Board (UNEB), the National Curriculum Development Centre (NCDC) or the Ministry of Education and Sports. Grading options follow published guidance, but your school is responsible for checking that its grading settings match current official requirements.
3. Accounts and access
- Your school's administrators create accounts for staff and manage their roles. Each person should have their own account.
- Keep sign-in details confidential. The school is responsible for what is done through its accounts.
- Tell us promptly if you suspect an account has been misused, and remove accounts when people leave the school.
4. Your school's responsibilities
- Have a lawful basis for the personal data you put into Twegese, including the consent of parents or guardians where the Data Protection and Privacy Act, 2019 requires it, and extra care with sensitive data such as health information.
- Keep the information you enter accurate, and review marks, grades, positions and comments before you publish them or print report cards.
- Send SMS only to people who expect to hear from the school, only about school matters, and in line with the rules of the Uganda Communications Commission.
- Use Twegese in line with the law and these terms.
5. Acceptable use
You must not, and must not allow anyone to:
- try to access accounts, schools or data you are not authorised to access, or test, probe or disrupt our systems (this can also be an offence under the Computer Misuse Act, 2011);
- upload unlawful, harmful or infringing content, or malicious software;
- send unsolicited or misleading messages through Twegese;
- copy, resell or sublicense Twegese, or reverse-engineer it except where the law allows; or
- place an unreasonable load on the service, for example with automated scripts.
6. Fees and payment
- Fees are per term, in Uganda shillings, as shown on our website or in a written quote.
- We invoice at the start of each term. Please pay by the due date on the invoice. Any taxes that apply are shown on the invoice.
- SMS are not included in the subscription plans. A school buys prepaid SMS credit from Bitosoft Innovations Hub Co. Ltd at the price per SMS shown in Twegese at the time of purchase (currently UGX 45). One credit sends one SMS of up to 160 characters (70 with special characters) to one phone; longer messages use more credits. Credit is added once the payment has been received.
- If your school grows beyond its plan's learner limit, we may ask you to move to a plan that fits.
- We will give at least 30 days' notice of any price change, which applies from the next term.
- Refunds are covered by our Refund Policy.
7. Your data
Your school owns the information it puts into Twegese. You allow us to host, copy, process and display it only as needed to provide, secure and support the service. Our Privacy Policy explains how personal data is handled.
You can ask us for a copy of your school's records while your subscription is active and when it ends. After the service ends, we delete your school's data as described in the Privacy Policy.
8. Data processing terms
For personal data we process for your school, we act as your data processor and we will:
- process it only to provide Twegese and on your documented instructions, including these terms;
- make sure our staff and service providers who can access it are bound by confidentiality;
- keep appropriate technical and organisational security measures in place;
- use only the service providers listed in our Privacy Policy, on terms that protect the data, and tell you before adding new ones;
- transfer data outside Uganda only where the Data Protection and Privacy Act, 2019 allows it;
- help you respond to requests from people exercising their rights, and to the Personal Data Protection Office;
- tell you without undue delay after we become aware of a security incident affecting your data;
- return or delete the data when the service ends, unless the law requires us to keep it; and
- give you the information you reasonably need to show that these obligations are met.
9. Third-party services
Some features rely on other companies: SMS delivery, payment notifications from providers your school chooses, and the optional AI Support assistant. We are not responsible for failures of services we do not control, but we will help you resolve problems where we can. AI Support answers are generated automatically and can be wrong, so check important steps before relying on them.
10. Availability and support
We work to keep Twegese available and to fix faults promptly, but we cannot promise that it will always be uninterrupted or error-free. Where practical, we plan maintenance outside school hours and give advance notice. Support is provided through the contact details on this website.
11. Intellectual property
We own Twegese, its software, design and documentation, and the Twegese name and logo. During your subscription, your school has a non-exclusive, non-transferable right to use Twegese for its own school administration. If you send us suggestions, we may use them without any obligation to you.
12. Confidentiality
Each of us will keep the other's confidential information secret and use it only for the purposes of this agreement, except where disclosure is required by law.
13. Our commitments and their limits
We will provide Twegese with reasonable care and skill. Apart from what these terms say and what the law requires, Twegese is provided as it is, and we do not promise that it will suit every school's particular needs. Nothing in these terms takes away rights that the law does not allow to be excluded.
14. Liability
- Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, or any other liability that cannot be limited by law.
- Neither of us is liable for indirect or consequential loss, or loss of profit or opportunity.
- Otherwise, our total liability to the school in any 12-month period is limited to the fees the school paid us for Twegese in that period.
15. Suspension and ending the service
- You can stop using Twegese at the end of any term by telling us in writing before the next term begins.
- We may suspend access if an invoice remains unpaid after we have given written notice and at least 14 days to pay, or immediately if needed to deal with a security threat or a serious breach of these terms.
- Either of us may end this agreement if the other seriously breaches it and does not put things right within 30 days of written notice.
- When the service ends, access stops. You can ask for a copy of your school's records, as described in section 7.
16. Changes to these terms
We may update these terms. For important changes we will give schools at least 30 days' notice before they take effect. If you do not agree, you can stop at the end of the current term.
17. Law and disputes
These terms are governed by the laws of Uganda. If a dispute arises, we will both first try to settle it through good-faith discussion. If that fails, the courts of Uganda have jurisdiction.
18. Contact and notices
Send notices to us at [email protected]. We will send notices to the school's contact details on record.
